Terms & Conditions

The trade mark TECH IP Legal Seminars is a trade mark of TECH IP Professional Development Pty Ltd. Your contract is with TECH IP Professional Development Pty Ltd.

Definitions

“Materials” means slide presentations, papers, case summaries, handouts and other materials other than Recordings. “Material” has the singular meaning.

"Seminars" means seminars or workshop training (whether public or in-house).  “Seminar” has the singular meaning.

“Recordings” means recordings (including audio and video recordings). “Recording” has the singular meaning.

“Registrant” means any person who registers for any Seminar, Webinar or Recording.

“Webinars” means webinars (whether public or in-house). “Webinar” has the singular meaning.

Cancellation

TECH IP Professional Development reserves the right to cancel or reschedule its Seminars, Webinars or Recordings, change the speakers, venue or program. However, in such a situation you will be provided with the option to cancel the Seminar, Webinar or Recording registration and have the registration fee refunded.

If you cancel your registration and that cancellation is received in writing 7 business days or more prior to the day of the Seminar or Webinar (or prior to your accessing the Recording) then your registration fee will be refunded in full less a AUS $40 administration fee. No fee will be refunded for any cancellation received after that time. You may transfer the registration to another person.

Intellectual Property

The intellectual property in the Materials is that of the relevant speaker or the organisation of which the speaker is an employee or partner. The Materials may not be electronically forwarded, printed or photocopied except for the use of the Seminar or Webinar or Recording registrant.

The intellectual property in the Recordings is that of TECH IP Professional Development.

The Recordings are only for the use of registrants authorised by TECH IP Professional Development and are not for access by other persons.

The Recordings can be accessed as many times as the registered user wishes during a period of 16 weeks following receipt of the link to the Recordings.

No copy, recording or reproduction of the Seminars, Webinars or Recordings is permitted to be made.

Disclaimer

The comments and opinions expressed by the speakers at the Seminars and Webinars, and in the Recordings and Materials, are those of the speakers. They are not those of TECH IP Professional Development.

The information provided at the Seminars and Webinars, and in the Recordings and Materials constitute general commentary only. That information should not be regarded as advice. Registrants should not act, or omit to take action, or make any decision, on the basis of any information provided at the Seminars or Webinars or in the Recordings or Materials. Registrants should seek their own legal and other professional advice for their specific circumstances.

Liability

(a)

If the Competition and Consumer Act 2010 (Cth) or any other Act implies into these terms and conditions or provides to a Registrant or his/her employer in connection with the supply of goods or services, a guarantee, term, condition or warranty which cannot be excluded, restricted or modified then any liability on the part of TECH IP Professional Development for any breach of such guarantee, term, condition or warranty shall be limited to the payment of the cost of supplying the services again.

 

(b)

All other guarantees and implied terms, conditions and warranties are excluded from these terms and conditions.

 

(c)

Subject to (a) above, in the event that TECH IP Professional Development is liable to any Registrant or his/her employer in respect of:

 

(i)

any Seminars, Webinars, Recordings or Materials; or

 

(ii)

 

anything said or not said, or done or omitted to be done, related to or incidental to any Seminars, Webinars, Recordings or Materials,

 

 

then TECH IP Professional Development's total cumulative liability whatsoever (including in negligence) to such Registrant and his/her employer is limited to a maximum amount of AUD $100 in respect of the Registrant and AUD $100 in respect of the employer.

Governing Law and Jurisdiction

The law that shall apply is that of Victoria, Australia. The parties agree to submit to the exclusive jurisdiction of the courts exercising jurisdiction in Victoria, Australia.
